Selamat datang di webexpress.id. Dengan menggunakan layanan kami, Anda setuju untuk terikat dengan syarat dan ketentuan berikut. Harap membaca dengan seksama sebelum memulai project.

1. Definisi Layanan

1.1 Paket Layanan

webexpress.id menyediakan paket layanan website (sesuai scope yang disepakati dalam quotation/proposal):

• Company Profile Website — Website multi-halaman untuk kredibilitas bisnis
• Personal Branding Website — Website untuk founder/profesional/personal brand
• Landing Page Campaign — Single-page high-converting untuk campaign/lead gen
• Blog / Content Hub — Website berbasis konten untuk kebutuhan SEO jangka panjang
• Portofolio / Showcase Website — Website galeri karya, studi kasus, dan inquiry

Catatan: Jumlah halaman/fitur dapat berbeda per paket dan akan ditulis jelas di quotation/proposal.

1.2 Model Pembelian

Setiap paket layanan tersedia dalam dua model pembelian:

A. Paket Beli Putus (One-Time Purchase)

• Client membeli source code website dengan hak kepemilikan penuh
• Client host sendiri di server/VPS pilihan client (on-premise)
• Tidak termasuk layanan hosting dari kami
• Support & maintenance: 30 hari gratis (lihat Section 7.2), setelah itu per-case basis (berbayar)
• Cocok untuk: Client dengan infrastruktur IT sendiri, butuh full control atas server

B. Paket Include Hosting (Subscription)

• Website di-host di server kami (managed hosting)
• Termasuk layanan hosting, uptime monitoring, server maintenance
• Support & maintenance: Selama langganan aktif (lihat Section 7.1) + 30 hari free revision (lihat Section 7.2)
• Subscription model: Tahunan (renewal setiap tahun)
• Cocok untuk: Client yang ingin hassle-free, tidak punya infrastruktur IT, fokus ke bisnis

1.3 Scope Layanan Standar

Setiap paket mencakup:

• Brand positioning strategy
• Professional copywriting (jumlah kata mengikuti paket/quotation)
• Custom design yang disesuaikan dengan brand identity
• Responsive development (mobile-first)
• On-page SEO optimization (meta tags, structured data, sitemap)
• Performance optimization (target <3 detik mobile load time)
• SSL security & HTTPS implementation
• Google Analytics setup & basic conversion tracking
• Domain & hosting consultation
• Basic legal pages (Privacy Policy, Terms of Service)

1.4 Add-on Services (Biaya Terpisah)

• CMS setup & training (Strapi)
• Additional copywriting (per halaman)
• Custom AI photography/videography
• Advanced animations & interactions
• Custom illustrations

2. Timeline & Delivery Terms

2.1 Garansi 3 Hari Kerja

Website akan live dalam maksimal 3 hari kerja dengan ketentuan:

Hari kerja didefinisikan sebagai:

• Senin - Jumat, pukul 08.30 - 17.30 WIB
• Tidak termasuk: Sabtu, Minggu, dan hari libur nasional Indonesia

Perhitungan timeline dimulai saat:

• Client telah submit brief lengkap melalui form yang disediakan
• Deposit/full payment telah lunas dan terkonfirmasi
• Semua materials pendukung telah diterima (logo, brand guidelines, referensi, content)

2.2 Breakdown Timeline

• Hari Kerja 1 (EOD): Preview design mockup homepage + 1-2 key pages + copywriting draft
• Hari Kerja 2: Design revisions → approval → development → content population
• Hari Kerja 3: QA testing → SEO setup → final review → go live

2.3 Timeline Extension

Timeline dapat diperpanjang dalam kondisi berikut:

• Client delay: Approval design >24 jam dari submission = timeline pause
• Revision berlebihan: Major revision >3 rounds = +1-2 hari kerja
• Scope changes: Penambahan halaman/fitur di tengah project = timeline adjustment
• Force majeure: Emergency, sakit, bencana alam = extension dengan pemberitahuan maksimal 4 jam kerja
• Incomplete materials: Brief tidak lengkap atau materials pending dari client

2.4 Preview Design Day 1

Preview design yang diberikan pada hari kerja pertama mencakup:

• Mockup design homepage + 1-2 halaman kunci (bukan full site)
• Copywriting draft untuk approval (belum final polish)
• Presentasi dilakukan pada EOD (End of Day) hari kerja pertama
• 1x revision request pada tahap ini tidak menambah timeline
• Client approval diperlukan untuk lanjut ke development

3. Revision Policy

3.1 Revisi Post-Launch

Revisi sejak website live, dengan ketentuan:

Minor Revisions (Unlimited):

• Text changes (maksimal 500 kata per bulan)
• Image swap (ukuran/dimensi sama)
• Color adjustments (maksimal 2 warna)
• Link updates
• Typo corrections

Major Revisions (Maksimal 3 Rounds dalam 30 hari kalender):

• Layout restructure
• Design overhaul per section
• Copywriting major rewrite
• Setiap round maksimal 5 item changes per submission
• Response time client maksimal 48 jam per round, atau periode hangus

NOT Included in Free Revisions:

• Halaman baru
• Fitur baru (forms, integrations, etc.)
• Redesign total
• Animasi/interactions baru
• Content strategy changes
• SEO content writing tambahan

3.2 Revision Request Process

• Submit via revision request form (akan disediakan)
• Include screenshots + clear description
• Prioritize items (most important first)
• Response time: 2-3 hari kerja per revision

3.3 Out-of-Scope Changes

Changes di luar scope paket akan dikenakan biaya addon sesuai complexity:

• Minor addon (simple changes): Rp 500k - 1 juta
• Major addon (new pages, features): Rp 1 juta - 5 juta
• Quote akan diberikan sebelum execution

4. Client Responsibilities

4.1 Brief & Materials Submission

Client bertanggung jawab menyediakan:

• Brief lengkap (via form template yang disediakan)
• Brand materials: Logo (vector format/png), brand guidelines (jika ada), color palette
• Content: Text content, images, videos (licensed/owned)
• References: Contoh website yang disukai, kompetitor list
• Access: Domain access (jika diperlukan)

Timeline tidak dimulai jika materials belum lengkap.

4.2 Approval Timeline

Client wajib memberikan approval/feedback dalam:

• Copywriting draft: Maksimal 24 jam (1 hari kerja)
• Design mockup: Maksimal 24 jam (1 hari kerja)
• Final review pre-launch: Maksimal 24 jam (1 hari kerja)

Delay approval = timeline pause.

4.3 Feedback Quality

Feedback harus:

• Specific & actionable (bukan "kurang menarik", tapi "ubah warna header jadi biru navy")
• Konsisten dengan brand guidelines & brief awal
• Reasonable & within scope

Feedback yang contradict brief awal atau preference changes berkali-kali dapat dianggap scope change.

4.4 Payment Terms

• Deposit 75%: Before project start (untuk konfirmasi slot)
• Final 25%: Before website launch/handover
• Accepted payment: Bank transfer
• Invoice due: 3 hari sejak diterbitkan

5. Money-Back Guarantee

5.1 Timeline Guarantee

Jika website tidak live dalam 5 hari kerja karena kesalahan tim kami:

• Refund 50% deposit (jika delay >10 hari kerja atau project abandoned)

Syarat refund timeline:

• Client telah memenuhi semua responsibilities (brief lengkap, approval tepat waktu)
• Delay bukan disebabkan oleh client (approval delay, scope changes, materials pending)
• Delay bukan force majeure

5.2 Refund Process

• Submit refund request via email dengan supporting documents
• Review dalam 3-5 hari kerja
• Approval refund: Proses 7-14 hari kerja ke rekening asal

5.3 Refund Exclusions

Tidak berlaku jika:

• Client mengubah scope di tengah project tanpa timeline adjustment
• Client tidak responsive (approval delay >3 hari kerja)
• Feedback tidak jelas atau contradict setiap round
• Project sudah live dan functional sesuai scope

6. Design & Development Standards

6.1 Custom Design Definition

"Custom design" yang kami maksud:

• Brand-specific color palette, typography, imagery
• Layout disesuaikan dengan content & business goals
• Original hero sections & key visual components
• Menggunakan proven UI patterns (best practices UX/UI)

Bukan:

• 100% unique design dari nol tanpa pattern references
• Custom illustrations (available as addon)
• Complex custom animations (available as addon)

6.2 Copywriting Standards

Professional copywriting includes:

• Conversion-focused structure (AIDA, PAS framework)
• SEO-optimized headlines & meta descriptions
• Jumlah kata sesuai package
• 2x major revisions included (rewrite >50% = additional fee)

6.3 Technical Performance Standards

Kami guarantee:

• Page load speed: <5 detik (mobile), <3 detik (desktop)
• Mobile responsive: 100% functional di semua screen sizes
• Cross-browser: Compatible dengan Chrome, Firefox, Safari, Edge (latest versions)

Jika tidak meet standards, kami akan optimize hingga tercapai (no extra charge).

7. Post-Launch Support & Maintenance

Penting: Support & maintenance berbeda berdasarkan model pembelian yang dipilih.

7.1 Untuk Paket Include Hosting (Subscription)

7.1.1 Support Selama Langganan Aktif (Unlimited Duration)

Selama subscription tahunan aktif dan dibayar, client mendapatkan:

• Server & hosting management (uptime, performance optimization, server updates)
• Uptime monitoring (kami monitor 24/7 dan alert jika downtime)
• Security updates (theme updates, security patches)
• Bug fixing (technical issues, broken links, display errors)
• Email support (response <24 jam di hari kerja)
• SSL certificate renewal (auto-renewal setiap tahun)
• Backup management (weekly automated backups, 30-day retention)

7.1.2 30-Day Free Revision Period

Selain support di atas, 30 hari pertama post-launch juga mendapatkan:

• Minor revisions unlimited (lihat Section 3.1 untuk definisi)
• Major revisions maksimal 3 rounds (lihat Section 3.1)

Setelah 30 hari, revisions di luar bug fixing akan dikenakan biaya (per-case basis).

7.1.3 Additional Services (Berbayar)

Layanan tambahan available dengan biaya terpisah:

• Content updates (beyond minor changes limit): Quote per request
• Feature additions (new forms, integrations, pages): Quote per request
• Design refresh (redesign sections): Quote per request
• SEO optimization campaigns: Separate service package
• Performance audits & optimization: Quote per request

7.2 Untuk Paket Beli Putus (One-Time Purchase)

7.2.1 30-Day Free Support Period (One-Time)

Setelah website launch, client mendapatkan 30 hari kalender free support:

• Bug fixing (technical issues, broken links, display errors yang disebabkan oleh code kami)
• Minor revisions unlimited (lihat Section 3.1 untuk definisi)
• Major revisions maksimal 3 rounds (lihat Section 3.1)
• Email support (response <24 jam di hari kerja)
• Deployment assistance (jika client butuh bantuan upload ke server mereka)

NOT included in free support:

• Server/hosting issues (client responsibility)
• Server configuration & optimization
• Uptime monitoring (client responsibility)
• SSL setup di server client (kecuali via deployment assistance)
• Content updates (beyond minor changes limit)
• Feature additions
• Redesign/restructure

7.2.2 Post 30-Day Support (Per-Case Basis, Berbayar)

Setelah 30 hari, semua support requests akan dikenakan biaya berdasarkan:

• Complexity/beban kerja: Simple fix (Rp 300k-500k), Medium complexity (Rp 500k-2jt), Complex (Rp 2jt-5jt+)
• Urgency: Normal (3-5 hari kerja), Rush (1-2 hari kerja, +30% fee), Emergency (<24 jam, +50% fee)
• Type of work: Bug fixing (lower rate), feature addition (higher rate), debugging server issues (highest rate)

Quotation akan diberikan sebelum work dimulai. Client berhak decline jika tidak sesuai budget.

7.2.3 Server & Hosting Responsibility

Untuk paket Beli Putus, client bertanggung jawab penuh atas:

• Server/VPS rental & payment
• Server configuration & optimization
• SSL certificate installation & renewal
• Uptime monitoring
• Backup strategy & execution
• Security updates (OS level, server level)
• Domain pointing & DNS configuration

Kami dapat assist dengan biaya tambahan (server setup fee: Rp 1-3 juta one-time, tergantung complexity).

7.3 Migration Between Models

Client dapat migrate dari satu model ke model lainnya:

Dari Beli Putus → Include Hosting:

• Migration fee: Rp 2-5 juta (tergantung complexity)
• Subscription dimulai setelah migration selesai
• Website akan di-migrate ke server kami

Dari Include Hosting → Beli Putus:

• Source code handover fee: Start From Rp 5 juta (tergantung package dan kompleksitas website)
• Client bertanggung jawab setup server sendiri
• Client menyediakan spek server sesuai dengan minimum spek yang kami informasikan
• Grace period 30 hari untuk migration (website masih online di server kami)
• Setelah 30 hari, website akan di-takedown dari server kami

7.4 Ongoing Partnership Options (Untuk Semua Model)

• Retainer packages (monthly/quarterly support hours): Custom pricing
• SEO optimization services: Separate package
• Content writing services: Per-word atau per-page pricing
• Feature enhancements & upgrades: Quote per project
• A/B testing & conversion optimization: Performance-based pricing available

8. Intellectual Property & Ownership

8.1 Ownership After Payment

Untuk Paket Beli Putus:

Setelah full payment lunas, client memiliki:

• Source code lengkap (frontend + backend, dengan basic dokumentasi)
• Design files (exported assets)
• Content & copywriting (full ownership)
• Images yang kami provide (stock photos licensed to client jika ada)
• Full rights untuk modify, distribute, resell, use tanpa batasan
• Database structure & schema (jika applicable)

Client bebas untuk:

• Host di server manapun (shared hosting, VPS, cloud)
• Modify code sesuai kebutuhan (dengan/tanpa developer lain)
• White-label untuk end clients (jika agency partner)
• Transfer ke developer lain untuk maintenance

Untuk Paket Include Hosting:

Client memiliki:

• Content & copywriting (full ownership)
• Design concept (visual identity yang dibuat untuk mereka)
• Rights to use website selama subscription aktif

Client TIDAK memiliki:

• Source code (tetap milik webexpress.id)
• Design files (Assets/source files)

Namun, client dapat:

• Request source code handover (dengan migration fee, lihat Section 7.3)
• Export content by request / via CMS
• Backup data secara berkala

Transisi dari Include Hosting ke Beli Putus akan memberikan full ownership seperti model Beli Putus.

8.2 Our Portfolio Rights

Kami berhak:

• Display website di portfolio kami (public showcase)
• Create case study (dengan client permission untuk details)
• Use as reference untuk pitching

Jika client ingin NDA/confidentiality, inform sebelum project start.

8.3 Third-Party Assets

• Stock photos: Licensed via legal stock sites (Unsplash, Pexels, AI Generate Image, etc.)
• Fonts: Open-source atau licensed untuk web use
• Plugins/themes: GPL atau properly licensed
• Client responsible untuk licenses jika request specific premium assets

9. Disclaimers & Limitations

9.1 Conversion Performance Disclaimer

Website kami design dengan conversion best practices, namun actual conversion rate dipengaruhi oleh:

• Traffic quality (marketing, ads, SEO efforts)
• Product-market fit
• Pricing competitiveness
• Customer service quality
• Brand reputation
• Market conditions

Kami tidak guarantee specific conversion rates, sales numbers, atau ROI metrics.

9.2 SEO Performance Disclaimer

Kami setup on-page SEO (technical optimization), namun:

• Ranking results depend on competition, domain authority, backlinks, content quality (ongoing effort)
• Kami tidak guarantee page 1 Google rankings
• SEO is long-term strategy (3-6 months untuk results)

Full SEO campaigns available as separate service.

9.3 Third-Party Services & Hosting Disclaimer

Kami integrate third-party services (Google Analytics, CMS, dll.), dengan ketentuan berbeda per model:

Paket Include Hosting:

Kami bertanggung jawab atas:

• Server uptime & performance (target 99.5% uptime)
• Server-level technical issues
• Hosting environment optimization
• SSL certificate management
• Server security patches

Kami TIDAK bertanggung jawab atas:

• Domain renewal (client responsibility atau dapat di-manage oleh kami dengan fee)
• Third-party service downtime (Google Analytics, payment gateways, etc.)
• DDoS attacks (beyond our infrastructure capacity)
• Content legality issues

Paket Beli Putus:

Client bertanggung jawab penuh atas:

• Server/VPS rental, payment, maintenance
• Uptime & performance
• SSL certificate installation & renewal
• Server security (firewall, OS updates, etc.)
• Backup & disaster recovery
• Domain & DNS configuration

Kami TIDAK bertanggung jawab atas:

• Server downtime atau performance issues
• Hosting-related bugs atau errors
• Data loss jika client tidak backup
• Compatibility issues dengan server client (kami test di environment standard)

Untuk Kedua Model:

• Client responsible untuk maintain third-party subscriptions (domain renewal, premium plugins, paid APIs, etc.)
• Terms of third-party services apply separately
• Kami tidak liable untuk service disruptions dari third-party providers

9.4 Browser & Device Compatibility

Website guaranteed compatible dengan:

• Modern browsers (latest 2 versions): Chrome, Firefox, Safari, Edge
• Mobile devices (iOS, Android latest OS)

NOT guaranteed:

• Internet Explorer (discontinued)
• Very old devices/browsers (>5 years old)

10. Force Majeure

Kami tidak bertanggung jawab atas delays/non-performance karena:

• Bencana alam (gempa, banjir, dll.)
• Pandemik/wabah penyakit
• Perang, kerusuhan, tindakan pemerintah
• Server/internet outage (beyond our control)
• Sakit/emergency tim key personnel

Dalam kasus force majeure:

• Timeline extension diberikan (reasonable duration)
• Pemberitahuan maksimal 4 hari kerja kepada client
• Bukan grounds untuk refund (project akan dilanjutkan)

11. Cancellation & Termination

11.1 Client Cancellation

Jika client cancel project:

• Sebelum project start: Full refund deposit (minus 10% admin fee)
• Setelah Day 1 design reveal: No refund (work substantially complete)

11.2 Our Cancellation Rights

Kami berhak terminate project jika:

• Client tidak responsive >7 hari kerja (tanpa komunikasi)
• Payment overdue >7 hari sejak invoice due date
• Client behavior unprofessional/abusive terhadap tim
• Scope creep excessive tanpa adjustment agreement

Dalam kasus ini, work yang sudah done akan di-charge prorata.

12. Confidentiality & Data Privacy

12.1 Confidential Information

Kami menjaga kerahasiaan:

• Business information client
• Proprietary data & trade secrets
• Login credentials & access details
• Financial information

Tidak di-share kepada third parties tanpa client permission.

12.2 Data Collection & Usage

Kami collect data untuk:

• Project management & communication
• Analytics (improve our services)
• Marketing (with opt-in consent)

13. Limitation of Liability

13.1 Maximum Liability

Total liability kami maksimal sebesar total project value (payment yang client bayar).

Kami tidak bertanggung jawab atas:

• Indirect/consequential damages (lost profits, business interruption)
• Data loss (client responsible untuk backups)
• Third-party claims
• Issues beyond our scope of work

13.2 Backup & Data Security

• Kami provide initial backup setup
• Client responsible untuk regular backups post-launch
• Kami recommend backup retention policy (7-30 hari)

14. Dispute Resolution

14.1 Communication First

Jika ada issue/dispute:

1. Contact project manager via email/WhatsApp
2. Escalate ke founder jika tidak resolved dalam 3 hari kerja
3. Good-faith negotiation untuk find solution

14.2 Mediation & Arbitration

Jika tidak resolved internally:

• Mediation dengan mediator netral (preferably)
• Arbitration sesuai hukum Indonesia (binding decision)

14.3 Governing Law

Terms ini governed by hukum Indonesia. Jurisdiction: Jakarta, Indonesia.

15. Amendments & Updates

15.1 Terms Changes

Kami berhak update Terms ini dengan:

• Notice 7 hari via email
• Updated version posted on website
• Continued use = acceptance of new terms

15.2 Existing Projects

Projects yang sudah dimulai akan follow Terms yang berlaku saat project start (bukan update).
